These Terms and Conditions apply to Zcalable.com website and embedded services, hereafter "the Service" operated by Zcalable™ hereafter "the Company";
concerning people who will interact with it in any form hereafter "the User".
The User's access to and use of the Service is conditioned by the User's acceptance of and compliance with these Terms and Conditions.
These Terms and Conditions apply to all visitors, users and others who access or use the Service.
The User may consume the Service only as permitted by applicable law, including export control laws and regulations.
By accessing or using the Service the User agrees to be bound by these Terms, if the User disagrees with any part of these then the User may not access or use the Service.
These Terms don't grant the User any right, title or interest on the content, logo and other visual media available with the Service
which are the property of the Company and are protected by copyright laws.
The Company provides advices on the data exchanged during the Service but does not own it. These Terms don't grant the Company with any rights on it.
The Company needs the User's permission to process those data within the limited rights that enable us to offer the Service.
If required a Non-disclosure agreement or similar document should be done, at the discretion of the User, in order to clarify the data usage.
The content provided with the Service makes no representation of the accuracy or completeness of any information.
The Company is not liable for any errors or omissions in information nor for the availability of this information.
The Company is not liable for any losses, injuries, or damages from the display or use of this information.
The Service allows the User to get, link, store, share and make available certain information, text, graphics, or other material.
The User is responsible for the proper use of this content, the Company is not responsible for the use the User might do of the content provided.
The Company is not responsible for the republishing of the content of the Service found on other websites or media without its permission.
The Company reserves the right to terminate the User's account if the User has not accessed the Service for 12 consecutive months.
The Company respects the intellectual property of others and asks the User to do so.
The Company responds to notices of alleged copyright infringement if they comply with the law, and such notices should be reported using DMCA Policy to contact@zcalable.com.
The Company reserves the right to suspend the collaboration alleged to be infringing and terminates collaboration with repeat infringers.
The Company collects and uses the following information to provide, improve and protect the Service:
Account: The Company collects, and associates with the User's account, information like name, email address, phone number, payment info, physical address, and account activity.
Usage: The Company collects information related to the usage of the Service to provide features such as targeted advices on specific subjects and secure connection.
Cookies and other technologies: The Company uses technologies like cookies which will use information about the User's device and visit only for Performance purposes to improve the Service. The User can set his browser to not accept cookies, but this may limit the ability to use the Service.
Third parties: The Company does not sell personal information to advertisers or third-parties.
If the Company may establish a partnership with a third-party, this Third-party will be bound to those General Terms and Conditions and the Customer will be informed by a new revision.
Security: The Company provides secure connection like encryption of the data, and alerts when a new location is accessing the User's data.
Retention: The Company retains the User's information and data for as long as the User needs the Service.
If the User's Purchase is terminated or suspended the User's content will be deleted as described in the related section.
If the User wishes to purchase any product or service made available through the Service, the User may be asked to supply certain information relevant to the Purchase including:
On-demand services start only when the agreed bill is paid, this amount is not refundable once the related service delivery starts. (see exceptions in related section)
On-demand services expire after 90 calendar days from the purchase date, notifications are sent at the beginning of each month for availability and then expiration of the related service.
The User is responsible for all applicable taxes, and the Company charges taxes when required to do so.
Subscription services are billed on a period specified on the service description. Periodic bills are sent 7 calendar days prior to the concerned period.
This amount is not refundable once the related period starts (see exceptions in related section), if the bill is not paid at the beginning of the period a notification is send
to the email provided for the Purchase and the Company reserves the right to suspend the Service.
Refunds are only issued if required by law.
Customers living in the European Union have the right to cancel their subscription within 14 days of signing up, upgrading to or renewing of the Service.
A refund may be issued at any time during the Period of the first month of trial if the User actively participates to the Service and objectives set by both the User and the Company at the beginning of the Period are not reached.
The Company keeps the right to terminate the Service if the customer enters in conflict with Agreed General Terms and Conditions.
Some countries have mandatory local laws regarding the User's cancellation rights, and this paragraph doesn't override these laws.
The Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. The User further acknowledges and agrees that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
The Company reserves the right, at our sole discretion, to modify or replace these Terms and Conditions at any time.
What constitutes a material change will be determined at our sole discretion.
The Company publishes new revisions of General Terms and Conditions at least 30 calendar days prior to its effective date.
New revisions of General Terms and Conditions are sent to existing subscriptions at least 30 calendar days prior to its effective date.
By continuing to use or access the Service after changes come into effect, the Customer agrees to be bound by the revised Terms.
If the Customer disagrees he must cancel his account before the effective date, the Company may refund the prorated paid amount where applicable.
